This Privacy Policy describes how Nuvitru Wellness LLC ("Nuvitru," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit www.nuvitru.com (the "Site"), book or receive our services, purchase products, attend our clinic or events, or otherwise interact with us.
Health information is covered by a separate notice. Because much of what we do involves your health, we maintain a standalone Consumer Health Data Privacy Notice that governs "consumer health data" as defined by state law. Where that notice applies, it controls. Nuvitru is a cash-pay wellness practice and is not a HIPAA covered entity; your information is protected by the commitments in these notices and by applicable state privacy laws rather than by HIPAA.
2.1 Information We Collect
Information you provide directly:
- Contact and account data — name, email address, phone number, mailing address, date of birth, and login credentials for our client portal (hosted by Healthie).
- Health and wellness intake data — health history, symptoms, medications, supplements, dietary habits, lifestyle information, and goals you share through intake forms, sessions, messages, or our portal. (Governed by the Consumer Health Data Privacy Notice.)
- Payment data — billing name, address, and payment card details, processed by our payment processors. We do not store full card numbers on our own systems.
- Communications — emails, portal messages, SMS messages (if you opt in), reviews, testimonials you authorize, and survey or class registration responses.
Information collected automatically:
- Device and usage data — IP address, browser type, device identifiers, pages viewed, referring URLs, and interactions with the Site, collected via cookies and similar technologies (see the Cookie Policy).
- Marketing analytics — our Site is hosted on HubSpot and uses Google Tag Manager; these tools collect engagement data as described in the Cookie Policy.
Information from third parties:
- Scheduling and portal platforms (e.g., Healthie, Mangomint) when you book or manage appointments.
- Laboratories and supplement dispensaries you authorize us to work with in the course of your care.
2.2 How We Use Personal Information
We use personal information to: provide, personalize, and manage our services and programs; schedule appointments and manage your client portal; process payments and fulfill orders; communicate with you about your care, appointments, and account; send marketing communications where permitted (you can opt out at any time); operate, secure, and improve the Site and our services; comply with legal obligations; and establish, exercise, or defend legal claims.
We do not use or disclose consumer health data for purposes beyond those described in the Consumer Health Data Privacy Notice without your consent.
2.3 How We Share Personal Information
We share personal information only with:
- Service providers / processors acting on our behalf under contract — e.g., our EHR/portal (Healthie), booking (Mangomint), website and CRM (HubSpot), payment processors, email/SMS platforms, and IT providers.
- Laboratories and dispensaries you engage through your care, at your direction.
- Professional collaborators within your Nuvitru care team (e.g., dietitian, therapist, collaborating physician) for coordinated care, with your consent.
- Legal and safety recipients — where required by law, subpoena, or court order, or to protect the rights, safety, or property of Nuvitru, our patients, or others.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy's commitments.
We do not sell your personal information, and we do not sell or share consumer health data for targeted advertising
2.4 Your Privacy Rights
Depending on your state of residence (including Texas, California, Colorado, Connecticut, Virginia, Washington, Nevada, and others), you may have the right to: know/access the personal information we hold about you; correct inaccurate information; delete your information; obtain a portable copy; opt out of targeted advertising, sale, or certain profiling; and withdraw consent for consumer health data processing. You will not be discriminated against for exercising these rights.
To exercise any right, use the process described on the Privacy Requests page. If we deny your request, you may appeal as described there.
2.5 Data Retention
We retain personal information for as long as needed to provide services, meet clinical record-keeping standards, comply with legal and tax obligations, resolve disputes, and enforce agreements. Client care records are retained consistent with applicable professional record-retention requirements (generally a minimum of 5–7 years in Texas; longer for minors). When retention is no longer required, we delete or de-identify the data.
2.6 Security
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the data — including encryption in transit, access controls, and vendor due diligence. No system is perfectly secure; please notify us immediately at hello@nuvitru.com if you suspect unauthorized access to your account.
2.7 Children
Our Site and services are not directed to children under 13, and we do not knowingly collect their personal information online without parental consent. Services provided to minors as patients require a parent or legal guardian's consent and involvement.
2.8 Do Not Track & Opt-Out Preference Signals
Where required by law, we honor browser-based opt-out preference signals (such as Global Privacy Control) for the browser or device on which they are set.
2.9 Changes to This Policy
We may update this Policy from time to time. Material changes will be posted on this page with a new "Last updated" date, and where required by law we will provide additional notice or obtain consent.
